The Law Office of Kathy A. Our areas of practice include:

  • Parenting time and child support orders are always modifiable and should periodically be reviewed. For example, the parenting time schedule established for a young child may not remain in his or her best interests as the child matures. Parenting time is modified based upon the best interests of the child unless the modification entails a change of the residential parent, in which case physical and/or emotional endangerment to the child must be shown.
  • Parenting time modifications may also involve removal  issues when a parent attempts to  move a child out of state.  Interstate jurisdictional issues under the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA) may arise when out-of-state orders are involved.
  • Child support is also subject to modification and may be either increased or decreased if application of the guidelines to the new financial situation of each parent results in a recommended child support award that constitutes a 10% deviation from the prior award.  Interstate juridsictional issues under the Uniform Interstate Family Support Act (UIFSA) may a arise when out-of-state parties are involved.
  • Maintenance is usually modifiable if the current award has become unfair based upon changed circumstances of the parties.
